In a Wisconsin Divorce Use a Divorce Issues Checklist

by | Oct 17, 2013

I want to provide potential clients and friends with a Wisconsin Divorce Issues Checklist which provides insight into factors the court will consider in approving a final Wisconsin divorce settlement:

  1. Dissolution of marriage by divorce, legal separation or annulment
  2. Custody and placement of minor children, including day-to-day activities, day care, transportation responsibilities, holidays, vacations, etc.
  3. Removal of children from jurisdiction
  4. Child Support, including any deviation from child support guidelines and variable expenses
  5. Life insurance
  6. Automatic wage assignment for health insurance, child support, maintenance or family support
  7. Health insurance on minor children
  8. Uninsured medical expenses for minor children
  9. Private school tuition for children
  10. Health insurance on the parties
  11. Real property: marital residence, second home, commercial property, time shares, other real estate (transfer of deed, refinancing, sale)
  12. Marital expenses associated with real estate
  13. Retirement plans (401k, IRA, TSA, pension plans, including federal or military pensions) QDROs
  14. Businesses
  15. Bank accounts
  16. Investments
  17. Stock options
  18. Premarital or nonmarital assets
  19. Premarital or nonmarital debts
  20. Premarital agreement/postnuptial agreement
  21. Spousal support
  22. Pets
  23. Personal property division — vehicles, recreational vehicles, campers, airplanes, collections, furniture, electronics, tools, household goods, etc.
  24. Exchange date for personal property
  25. Division of marital debt
  26. Property settlement
  27. Tax consequences of property transfer, if any
  28. Life insurance to fund unpaid spousal support
  29. Sums owed under temporary order
  30. Tax exemptions for minor children, head of household and child care credit claims
  31. IRS Form 8332, to claim children as dependents
  32. Filing status for tax returns for last/current year
  33. Restoration of former name
  34. Attorneys fees
  35. Personal injury settlement proceeds
  36. And more

You want to make sure that all income, assets and liabilities are addressed in your final Marital Settlement Agreement.  If you have questions, ask your Wisconsin divorce lawyer before the divorce is finalized, not after when it may be too late.
